Who we are

Katatude is a brand of The Digital Sip Canada Inc., based in British Columbia, Canada. In these terms, "we", "us" and "our" mean The Digital Sip Canada Inc., and "you" means anyone using this website or enquiring about our services.

By using this site, you agree to these terms. If you do not agree with them, please do not use the site.

Using this site

You may use this site to learn about our services, contact us and book a call. You agree not to use it to do anything unlawful, to interfere with how it works, or to attempt to gain access to parts of it that are not public.

We may change, suspend or withdraw any part of the site at any time without notice.

Enquiries and bookings

When you submit a form or book a call, you agree that the information you give us is accurate and that you are authorised to provide it.

Booking a call does not create a contract for services and places no obligation on either of us. A call is a conversation, nothing more.

Our services

If we agree to work together, the work itself is governed by a separate written agreement between us, which sets out the scope, the fees, the term and what each of us is responsible for.

Where anything in that agreement conflicts with these terms, the agreement takes precedence.

Founding studio offer

Our founding studio offer is available to a limited number of new clients and may be withdrawn or changed at any time. Where it applies:

The first month of service is provided at no fee

A discount of 25% applies to the following five months

The offer applies to our entry level package only, and not to other packages or to additional work

The offer applies to our fees only, and does not include advertising spend or third party software costs

The offer is available to new clients only and cannot be combined with any other offer

The exact terms that apply to you will be set out in your written agreement.

Advertising spend and third parties

Advertising spend is separate from our fees and is paid by you directly to the advertising platforms. We do not take a percentage of your spend.

Our services depend on third party platforms, including advertising networks, email and messaging providers and software tools. We are not responsible for changes to their policies, pricing, availability or performance, or for any account suspension or restriction they apply.

No guarantee of results

Marketing results depend on many factors outside our control, including your location, your offer, your pricing, your competitors, your capacity and how enquiries are handled once we pass them to you.

We do not guarantee any particular result. Nothing on this site, in our marketing or in any conversation should be taken as a promise of a specific number of enquiries, trials, students or revenue. Any figures or examples we share are illustrative and are not a projection of what you will achieve.

Your responsibilities

Our work depends on things only you can do. Where we are working together, you agree to:

Give us access to the accounts and information we need, within a reasonable time

Review and approve work when we ask, so launches are not delayed

Respond to enquiries and leads that reach you

Make sure anything you give us to use is accurate and that you have the right to use it

Intellectual property

The content of this site, including text, design, graphics and the Katatude name and logo, belongs to us and may not be copied or reused without our written permission.

Where we create work for you as a client, ownership of that work is dealt with in your written agreement. Accounts we set up in your name, and the data in them, are yours.

Confidentiality

We treat information you share with us about your business as confidential and use it only to advise you or to carry out work you have asked us to do.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, including lost profit, lost revenue, lost data or loss of business opportunity, arising from your use of this site or from our services.

Where liability cannot be excluded, our total liability is limited to the fees you have paid us in the [three] months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot lawfully be limited.

Links to other sites

This site may link to websites we do not control. We include those links for convenience and are not responsible for their content, their accuracy or their privacy practices.

Privacy

How we handle your information is set out in our Privacy Policy, which forms part of these terms.

Changes to these terms

We may update these terms from time to time. The date at the top shows when they were last changed, and the version published here is the one that applies.

Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of British Columbia.
